DESKTOP ENGINEERING WORKSTATION SURVEY OFFICIAL RULES

1. NO PURCHASE NECESSARY. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. YOUR SURVEY RESPONSES DO NOT INCREASE YOUR CHANCES OF WINNING.

2. Name: This promotion, referred to herein as the “Survey,” is called the Desktop Engineering Workstation Survey.

3. How To Enter: Read these Official Rules and complete the survey at http://fluidsurveys.com/s/Desktop-Engineering-workstation-survey/. One survey entry will be accepted per person. All entries shall be deemed to have been made by the individual submitting the entry.More frequent entries will be disqualified. Level 5 Communications,  Inc. (“Sponsor”) is not responsible for lost, late,  misdirected, damaged, illegible, incomplete, garbled, or incorrect entries. Entries become the property of Sponsor and will not be returned. For a copy of these Official Rules, visit www.digitaleng.news/articles/aabfjg.htm or send a self-addressed stamped envelope to Workstation Survey Rules, Level 5 Communications, PO Box 1039, Dublin, NH 03444.Vermont residents may omit return postage. The Survey begins at 12:01am Eastern Standard Time on June 6th, 2012. All entries must be received by 11:59pm Eastern Daylight Time on July 16th, 2012 after which time the Survey will be closed and no further entries accepted. Your entry into the Survey constitutes acceptance of these Official Rules in their entirety.

4. Eligibility. The Survey is open to legal residents, 18 years of age or older as of the start date of the Survey, of the 50 United States and the District of Columbia, who possess internet access. Entrants must be (a) an engineer whose role is to produce product and system designs and/or perform design analysis and evaluation work using computer-aided engineering (CAE) and simulation tools; (b) an executive or manager whose primary job is to lead and manage engineering teams; (c) an executive, manager or staff person whose primary job position is their company’s IT department; (d) a C-level executive (CEO,  President, CIO etc). Employees of Sponsor, Sponsor’s affiliates,  representatives, agents and promotional partners, those domiciled with them, and their immediate families are not eligible. This offer is subject to applicable federal, state, and local laws and regulations. Void where prohibited. Winner must be able to accept,  install, and use Prize; see section 6. The internal laws of the state of New Hampshire will govern this Survey. Any and all legal actions or claims arising in connection with this Survey must be brought in a court of competent jurisdiction within Cheshire County,  New Hampshire. Entrant warrants that she/he is eligible to participate in the Survey and agrees to indemnify and hold harmless Sponsor from any loss, damage or expense arising out of or in connection with participation in this contest or the acceptance, use or misuse of any prize.

5. Privacy. When you enter the Survey, Sponsor will collect information to administer your participation in the Survey. Sponsor may use this information for other purposes consistent with its Privacy Policy, which may be found at /de/level-5-communications-inc-internet-privacy-policy.Entry information may also be provided by Sponsor to its promotional partner, Hewlett-Packard Company (“HP”). Survey responses will,  however, not be shared with HP. Sponsor shall not be responsible or liable for use of this information by HP.

6. Prize Details. One Prize,  consisting of an HP Z1 Workstation, shall be awarded to the individual survey entrant selected as the winner. The HP Z1 Workstation consists of:

  • GenuineWindows® 7 Professional 64

  • Processor: Intel® Xeon® E3-1245 (3.30 GHz, 8 MB cache, 4 cores)

  • Memory: 4 GB 1600 MHz DDR3 ECC Unbuffered RAM

  • Internaldrive:  1 TB 7200 rpm SATA NCQ

  • Opticaldrive:  SATA SuperMulti DVD+/-RW

  • Graphics: NVIDIA Quadro 500M (1 GB)

  •  

The approximate retail value of the HP Z1 Workstation is $2,599.00

The HP Z1 Workstation shall be delivered within 45 days from the date of the execution by the winner of the Declaration and Release as described in Section 8. The HP Z1 Workstation shall be delivered by FedEx, United Parcel Service, or other such courier service to a location and on a date agreed to by winner.

No prize substitution or cash redemption allowed by winner. Prize is not transferable.

Sponsor will issue a Form 1099-MISC reflecting the award of the Prize, and winner is liable and solely responsible for all federal, state, municipal income taxes and any other fees, costs, or taxes associated with winning or use of the Prize, as well as any additional hardware or software not identified in this Section 6.

Sponsor makes no representation or warranties concerning the appearance, safety or performance of any prize awarded. The HP Z1 Workstation shall be accompanied by HP’s standard product warranty. The warranty is provided by HP Services and includes a limited 3 years parts, 3 years labor, and 3 years onsite service (3/3/3) standard warranty. Certain restrictions and exclusions apply.

7. Selection of Winners:Potential winners will be determined in a random drawing to be conducted by Sponsor at its Dublin, New Hampshire offices on July 25th, 2012 from among all eligible entries received during the time period identified in Section 3. Odds of winning depend on the number of eligible entries received. The potential winner will be notified by e-mail, using the address provided in the application form and shall schedule a telephonic meeting with Sponsor to discuss acceptance and installation of the Prize, and the obligations attendant thereto. Before being declared a Winner, the selected entrant shall execute a Declaration and Release stating the entrant’s eligibility to win the prize and compliance with these Official Rules. If the prize winning notification is returned as undeliverable, winner does not respond to the notification within five business days, winner or his or her employer declines the prize,  or refuses to execute the Declaration of Release, the prize will be forfeited and shall be awarded to an alternate winner in a random drawing from remaining eligible entries.

8. Limitation of Liability.Each entrant into the Survey agrees to be bound by these rules and to release Sponsor, HP, their affiliates, directors, employees,  officers, and agents, including without limitation, its advertising and promotion partners, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize related activities.Under no circumstances will any entrant or Winner be permitted to obtain, and participants hereby waive all rights to, claim punitive,  incidental or consequential damages, or attorneys’ fees, and entrants further waive all rights to multiplied, increased or otherwise enhanced damages. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this promotion should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor or impair its administration, security,  fairness or proper play. In such an event, Sponsor may award prizes in a drawing from eligible entries received prior to cancellation or suspension. Sponsor is not responsible for technical, hardware,  software or telephone failures of any kinds, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by any of the equipment, programming or personnel associated with or utilized in this promotion.

9. Winner:  The winner will be identified on Sponsor’s website, at www.digitaleng.news and www.digitaleng.news/workstations. Alternately, send a self-addressed, stamped envelope to Winners, Level 5 Communications,PO Box 1039, Dublin, NH 03444, within 30 days of close of the Survey.

10. Sponsor:  Level 5 Communications, Inc., 1283 Main Street, Dublin, New Hampshire 03444.

CAUTION:  ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SURVEY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
