Overview
This site is part of the Level 5 Communications, Inc. (“Level 5”) network of web sites. The following Privacy Statement summarizes the various ways that Level 5 treats the information you provide while using any Level 5 site or service.  It is our goal to bring you information that is tailored to your individual needs and, at the same time, protect your privacy. This Privacy Statement does not cover information collected elsewhere,  including offline and on sites linked to or from any of our sites.

  Please read this Privacy Statement carefully. Your use of, accessing, and/or registration on any aspect of our sites will constitute your agreement to this Privacy Statement.   At Level 5 we take your privacy very seriously. Because of this we want to provide you with explicit information on how we collect, gather, and identify information during your visit to our site. Your continued use of our site signifies your acceptance of our privacy policy. This Privacy Statement may be modified from time to time; the date of the most recent revisions will appear on this page,  so check back often. Any change, update or modification we make will be effective immediately upon posting on our site(s). If we are going to be using the information collected from users in a manner materially different from that stated at the time of collection, we will send affected users written notice of the change by e-mail. Continued access of our sites by you will constitute your acceptance of any changes or revisions to the Privacy Statement.

Personally Identifiable Information refers to information that tells us specifically who you are, such as your name, phone number, email or postal address. In many cases we need this information to provide the personalized or enhanced service that you have requested.

  The amount of Personally Identifiable Information that you choose to disclose to Level 5 is completely up to you. The only way we know something about you personally is if you provide it to us in conjunction with one of our services.

Collection of Personal Information
In general, you may visit our sites without identifying yourself or revealing any personal information.

As you browse our sites a log file is created, collecting the IP address of your computer and other standard tracking data we use to evaluate site traffic and usage patterns. Such information is aggregated with tracking data from all site visitors. We use the information to personalize our sites according to your preferences based on the aggregated information. We also use the aggregated information to evaluate products and services we may offer to you.

  Portions of our sites may require you to give us personally identifiable information, such as your name, job title,  company, physical mailing address, e-mail address, telephone and fax numbers and, if applicable, financial information such as your credit card information,  for, among other purposes:
(i); subscriptions to our publications, including e-newsletters;
(ii) registration for attendance at certain Level 5 events; and
(iii) access to certain online content and functionality (use of our websites).

  If you communicate with us by e-mail,  post messages to any of our chat groups, bulletin boards or forums, or otherwise complete online forms, surveys or contest entries, any information provided in such communications may be collected as personal information. You always have the option not to provide the information we request. If you choose not to provide the information we request, you can still visit most of our sites, but you may be unable to access certain options and services.

  If you elect to provide us personal information, we use it primarily to deliver the service you requested. In addition, it is used for internal review; to improve the content of the site,  thus making your user experience more valuable; to notify you about updates to the service; and to let you know about products and services that you may be interested in.

  In our effort to provide personalization and opportunities for prizes and services, we may at times ask you to submit information such as your name or email address, or to share your interests and hobbies with us. You never have to answer these questions, and you can decline this exchange of information on any site on the Internet - not just ours - at any time. However, if you should choose to withhold requested information, we may not be able to provide you with some of the services dependent upon the collection of this information.

  The “email this article” feature is an easy way for you to send articles through email. The email addresses that you supply to use this service will not be used for any other purpose without your consent.
If you submit financial information, we use that information primarily to verify your credit and collect payments for your purchases, orders, registrations, etc.

Personal and Financial Information Sharing
We may share your personal information with our affiliates and with our partners, including our sponsors and advertisers, for marketing, advertising, and/or product/service offering purposes, and with others who are licensed to access your personal information by any of the foregoing. Also, we rent e-mail lists compiled from e-mail addresses gathered from our sites. While we will seek to require all such third parties to follow appropriate privacy policies and will not authorize them to use this information except for the express purpose for which it is provided, Level 5 does not bear any responsibility for any actions or policies of third parties.

If you do not wish to have your personally identifying information shared, or if you do not wish to receive future commercial communications from us by e-mail, you may unsubscribe or opt-out, as described below – see “Opt-Out Option.”

We also allow access to our database by third parties that provide us with services, such as development services, but only for the purpose of and to the extent necessary to provide those services.

In addition, we reserve the right to use the information we collect about your computer, which may at times be able to identify you, for any lawful business purpose,  including to help diagnose problems with our servers, to gather broad demographic information, and to otherwise administer our sites, or if required to do so by law or in the good faith belief that such action is necessary to conform to the edicts of the law or comply with legal process served on Level 5 or to protect and defend the rights or property of Level 5, or to enforce our terms of service.

Aggregated Information
While your personally identifying information is protected as outlined above, we reserve the right to use, transfer, sell, and share aggregated, anonymous data about our users as a group for any business purpose, such as analyzing usage trends and seeking compatible advertisers and partners.

Information on Children
Level 5 is committed to the safety of our children. As a business-to-business company, we do not knowingly collect information from children. On-line registration and web site usage is restricted to adults who are professionally engaged in the businesses we serve.

Third Party and Affiliated Links
Our sites may from time to time contain external links to other websites, including suppliers, advertisers and affiliates. We have no control over, and are not responsible for, the content of, or information gathered by, these other websites. We do not endorse any of these websites or the products or services associated with such websites merely because they are linked to any of our sites. In addition, users of our sites should also be aware that, when you voluntarily disclose personal information in chat areas or bulletin boards,  that information may be collected by others and may result in unsolicited messages from others.

Cookies
A “cookie” is a string of data sent by a website to a user that is inserted in a file of the web browser of the user visiting the site. Level 5 uses temporary, session-specific cookies to ensure visits to its website are smooth and customized for the visitor. Such cookies allow us to provide a visitor’s browser with information tailored to the visitor’s preferences and needs. Level 5 also uses permanent or persistent cookies that remain on a visitor’s computer after the visitor leaves a Level 5 website.

If you do not want your browser to accept cookies, you can turn off the cookie acceptance option in the browser’s settings. However, disabling the cookie support function of the browser will prevent our website from functioning properly and you may not be able to use fully all of the site’s features and information.
We use advertising companies to develop banner ads for our website. These ads may contain cookies. These companies collect cookies sent to your browser through the banner ads and we do not have control of, or access to, this data.

Opt-Out Option
Visitors to our sites can decide if they want to receive targeted promotional information from Level 5 or targeted promotional information sponsored by our marketing partners. On the visitor registration pages, prospective visitors can choose to request that we not e-mail them advertising and promotional information from Level 5 or our partners. Should visitors accept promotional email from Level 5, any email they receive will include instructions on how to be removed from our promotional email list.

If you do not wish to have your personally identifying information shared, or if you do not wish to receive future commercial communications from us by e-mail, you may change your preferences at any time simply by: (i) writing to us (and please include your e-mail address), or (ii) by following the unsubscribe instructions contained within the e-mail you receive from us. We will update your preferences as soon as is reasonably practicable. If you have registered on any part of our sites, please use the mechanism on our sites that allows you to change or update your profile, preferences or information, if available, to keep all such data accurate and up-to-date. The only item of information you cannot change is your username ID selected at registration for a trade show,  event or conference.

Please note that if you opt-out as described above, we will not be able to remove your personal information from the databases of third parties with which we have already shared your personal information (i.e., to which we have provided your personal information prior to our receipt of your opt-out request). However, we will make every reasonable effort to forward your opt-out request (including your e-mail address) to the specific third-party marketer whose offer you received from us prompting your opt-out or unsubscribe request, so that it can include your e-mail address on its own do-not-email list. Level 5 does not bear any responsibility for ensuring that any third party complies with your opt-out or unsubscribe request vis-à-vis its own lists.

Security and Encryption
We use procedural and technical safeguards to protect your personal information against loss or theft as well as unauthorized access and disclosure to protect your privacy, including encryption, “firewalls” and Secure Socket Layers. We treat data as an asset that must be protected against loss and unauthorized access. We employ many different security techniques to protect such data from unauthorized access by users inside and outside the company. However, “perfect security” does not exist on the Internet.

Exceptions
As our business changes, we may buy or sell various assets. In the event all or a portion of the assets owned or controlled by Level 5, or any subsidiary or affiliated entity, are sold, assigned, transferred or acquired by another company,  information from and about our visitors, including Personal Information and Financial Information, may be among the transferred assets.

Whenever you voluntarily make your personal information available for viewing by third parties online - for example in chat rooms or on message boards – Level 5 has no ability or obligation to prevent third-party access to such information and Level 5 undertakes no responsibility to keep such information private.

Notification of Changes
Level 5 reserves the right, at any time and without notice, to add to, change, update or modify this privacy policy, simply by posting such change, update or modification on the website. Any such change, update or modification will be effective immediately upon posting on the website.

Your Acceptance of these Terms
By using our website, products or services, you signify your acceptance of the terms of the Level 5 Privacy Policy. If you do not agree to the terms of our Privacy Policy,  please do not use the website, products and/or services and exit the site immediately.

Social Security Number Privacy Policy
Statement of Purpose:
Level 5 Communications Inc. (together with its affiliated entities, “Level 5”) has created this Social Security Number Privacy Protection Policy to demonstrate its commitment to maintaining the confidentiality of social security numbers Level 5 obtains in the ordinary course of its business activities from customers,  creditors, contractors, vendors, employees and other individuals associated with Level 5.

It is the policy of Level 5 to handle social security numbers obtained in the ordinary course of its business activities with a high degree of security and confidentiality. In general, Level 5 restricts access to information and documents containing social security numbers to Level 5 employees, agents and contractors who have a legitimate business reason to access such information and documents. Level 5 will ensure, to the extent practicable, that no individual associated with Level 5 obtains, stores, transfers, uses, discloses, or disposes of a social security number that Level 5 has obtained or possesses except in accordance with applicable law and this Privacy Policy. All Level 5 departments and business units having access to information, documents and records containing social security numbers will determine on an ongoing basis which personnel have a legitimate business reason to access those materials. No other Level 5 personnel will be authorized to access social security numbers maintained by Level 5.

Procedures:
Protection of Social Security Numbers
In an effort to protect the privacy rights of individuals who provide their social security numbers to Level 5, Level 5 will ensure, to the extent practicable, that:

  • The confidentiality of social security numbers is maintained
  • Social security numbers are not unlawfully disclosed
  • Records containing social security numbers are disposed of in a commercially reasonable manner (such as destroying, erasing or making unreadable social security numbers contained in data, computer files and documents) that minimizes the risk that social security numbers maintained by Level 5 will be obtained by unauthorized persons
  • Social security numbers are not publicly displayed, used as the primary account number or identifier for an individual or printed on identification cards or badges
  • Social security numbers are not used, transmitted or stored in documents, files, computer programs or databases that are not encrypted or secure
  •  

Authorized Use of Social Security Numbers
This Privacy Policy does not prohibit the use of social security numbers obtained by Level 5 where the use is authorized or required by state or federal statute, rule,  regulation, or court order or rule, or pursuant to legal or discovery process.

This Privacy Policy does not prohibit the collection or use of social security numbers belonging to customers, creditors, contractors, vendors, employees and other individuals associated with Level 5 for other legitimate business reasons,  including, without limitation:

  • The conduct by Level 5 of pre-employment background, reference and related inquiries
  • For purposes of verifying employment candidates’ eligibility for employment by Level 5
  • For employee tax reporting purposes, including new hire reporting and enrollment and participation in Level 5 benefit plans
  • For tax reporting purposes pertaining to customers, creditors, contractors, vendors and other individuals providing goods or services to Level 5
  •  

Unauthorized Use or Disclosure
Level 5 will take commercially reasonable measures to enforce this Privacy Policy and to correct and prevent the reoccurrence of any known violations. Non-compliance with this Privacy Policy may constitute a violation of federal and state law,  and Level 5 will fully cooperate with all law enforcement and administrative agencies in the apprehension and prosecution of any person who knowingly obtains, uses or discloses social security numbers for any unlawful purpose. Willful violation of this Privacy Policy by Level 5 employees will result in disciplinary action up to and including discharge.

Notification of Changes
Level 5 reserves the right, at any time and without notice, to add to, change, update or modify this privacy policy, simply by posting such change, update or modification on the website. Any such change, update or modification will be effective immediately upon posting on the website.
